Introduction – Welcome to Power Saber™
Blast Lab LLC operates www.thepowersaber.com and sells the Power Saber™ on behalf of Nextoy LLC and brand owner Goliath Games.
The Power Saber™ is an original creation of Nextoy LLC and its manufacturing and brand partner Goliath Games. It is a patented, automatic extending and retracting toy lightsaber featuring vivid LED illumination, motion-activated cinematic sound effects, and a durable, collapsible polycarbonate blade.
The Power Saber™ is NOT an official Star Wars®, Lucasfilm, or Disney product and has no affiliation with, and is not endorsed by, any Star Wars® property.
By accessing or using this Site, placing an order, or clicking “I Accept” (where presented), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must immediately exit the Site and may not purchase any product.
1. Acceptance of Terms
1.1 These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Blast Lab LLC, a California limited liability company that operates www.thepowersaber.com and sells the Power Saber™ as an authorized licensee and on behalf of the brand owner, Goliath Games (“Blast Lab,” “we,” “us,” or “our”).
1.2 These Terms govern your access to and use of www.thepowersaber.com (the “Site”), all purchases of Power Saber™ products (the “Product”), and any related services provided through the Site.
1.3 By browsing the Site, creating an account, placing an order, or otherwise using the Site, you unconditionally accept and agree to be bound by these Terms and our Privacy Policy.
1.4 We may modify these Terms at any time. Revised Terms become effective immediately upon posting on the Site. Your continued use of the Site, or your retention of any Product purchased from us, after such posting constitutes your acceptance of the updated Terms.
2. Eligibility
2.1 You must be at least 18 years of age or the age of majority in your jurisdiction to place an order.
2.2 By placing an order, you represent and warrant that you are legally capable of entering into binding contracts.
2.3 Parents or guardians may purchase Products for minors, provided all use by minors occurs under direct adult supervision.
3. Products & Services Description
3.1 The Site offers for sale the Power Saber™ — a patented toy featuring automatic blade extension/retraction, bright LED lighting, motion-sensor sound effects, and a collector-grade hilt.
3.2 All Product images, videos, specifications, and descriptions are illustrative and may have been created or enhanced using artificial intelligence (AI) tools. Slight variations in color, finish, sound, or performance may occur due to manufacturing, photography, or AI generation.
3.3 The Power Saber™ is NOT an official Star Wars®, Lucasfilm Ltd., or Disney product and is not sponsored, endorsed, or licensed by any of them.
4. Pricing & Payment
4.1 Prices are shown in U.S. dollars (USD), exclude sales tax, shipping, customs duties, and any other fees unless expressly stated.
4.2 We reserve the right to change prices at any time before order confirmation.
4.3 Payment is processed securely through Shopify Payments, Stripe, and/or other PCI-compliant payment processors we may use from time to time. By providing your payment information, you authorize us (or our processor) to charge the full amount at the time of purchase.
4.4 You represent that you are authorized to use the payment method provided.
5. Order Acceptance & Cancellation
5.1 Submission of an order constitutes an offer to purchase. We may accept or reject any order in our sole discretion (including for suspected fraud, pricing errors, or stock issues).
5.2 No binding contract exists until we send an order confirmation email.
5.3 If we cancel an order after charging your payment method, we will refund will be issued to the original payment method within 5–10 business days.
6. Shipping
6.1 Shipping options, costs, estimated delivery times, and eligible countries are displayed at checkout.
6.2 Title and risk of loss pass to you when the Product is handed to the carrier (FOB shipping point).
6.3 We are not liable for delays caused by carriers, customs clearance, or events beyond our reasonable control.
6.4 Full details of shipping methods, timelines, restrictions, and international duties are set forth in our separate Shipping, Returns & Refund Policy, which is incorporated on our website.
7. Returns, Refunds & Exchanges
7.1 We offer a 14-day return period from the date of delivery, subject to the conditions below.
7.2 Products must be unused, in original condition, and in undamaged original packaging with all accessories to be eligible for return.
7.3 Certain items (e.g., used or duel-damaged Products) are non-returnable.
8. Limited Warranty
8.1 Blast Lab LLC warrants to the original purchaser only that the Power Saber™ Product will be free from defects in materials and workmanship under normal use for a period of three (3) months from the date of delivery (“Warranty Period”).
8.2 This limited warranty covers only manufacturing defects. It expressly excludes:
(a) damage caused by misuse, abuse, accident, modification, dueling, impact with hard surfaces, or attempts to repair or modify the Product;
(b) normal wear and tears, cosmetic damage, scratches, dents, or discoloration;
(c) damage from improper storage, exposure to extreme temperatures, moisture, or liquids;
(d) battery leakage or improper battery installation;
(e) any Product purchased from unauthorized resellers.
8.3 If a valid warranty claim is submitted during the Warranty Period, Blast Lab will, at its sole option: (i) repair the Product, (ii) replace it with an identical or substantially similar Product, or (iii) issue a full refund of the original purchase price (excluding shipping).
8.4 To make a warranty claim, you must contact support@thepowersaber.com within the Warranty Period, provide proof of purchase, photos/video of the defect, and obtain a Return Merchandise Authorization (RMA). Unauthorized returns will be refused.
8.5 THIS LIMITED WARRANTY IS THE ONLY WARRANTY PROVIDED. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED (INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT) ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW.
9. Product Safety & Age Grading
9.1 The Power Saber™ is recommended for ages 6 and up. It is not intended for children under 3 years due to small parts and choking hazards.
9.2 The Product uses standard AA batteries (included), contains a retractable polycarbonate blade, and bright LED lights. Adult supervision is always required when children are using the Product.
9.3 The blade, while flexible and collapsible, can cause injury if swung at persons, animals, or fragile objects. Never aim at eyes or face.
9.4 You agree to follow all safety instructions included in the packaging and on the Site. Failure to do so avoids the limited warranty and may result in injury for which Blast Lab LLC is not responsible.
10. Use Restrictions & Critical Safety Disclaimer
10.1 The Power Saber™ is a toy intended solely for recreational play, cosplay, and display. It is NOT a weapon, sporting good, or protective device.
10.2 You expressly agree not to:
(a) use the Product in any manner that could cause bodily injury or property damage;
(b) swing, strike, or point the Product at any person’s or animal’s eyes or face;
(c) modify, disassemble, or attempt to repair the internal electronics or mechanism;
(d) use non-recommended batteries or power sources.
10.3 YOU ASSUME ALL RISK OF INJURY arising from use, misuse, or “dueling.” Blast Lab LLC will not be liable for any injury, damage, or loss resulting from improper or aggressive use.
11. Intellectual Property
11.1 “Power Saber™,” the Power Saber logo, and all related trade dress are trademarks or registered trademarks of Goliath Games or its licensors. Blast Lab LLC is an authorized licensee operating this Site and selling the Product on behalf of the brand owner.
11.2 All content on the Site (text, images, videos, software, and designs) is owned by Blast Lab LLC or its licensors and protected by U.S. and international copyright, trademark, and other laws.
11.3 The Power Saber™ is protected by one or more U.S. and international patents.
11.4 The Product and Site are NOT affiliated with, sponsored by, or endorsed by Lucasfilm Ltd., The Walt Disney Company, or any Star Wars® franchise. Any references to “saber,” “blade,” or similar terms are purely descriptive and do not imply affiliation.
11.5 Limited, non-transferable license: You may use the Site and Product only for personal, non-commercial purposes.
12. User-Generated Content & Social Media License
12.1 By posting, uploading, or submitting photos, videos, reviews, or other content featuring the Product (“User Content”), you grant Blast Lab LLC an irrevocable, perpetual, royalty-free, worldwide license to use, reproduce, modify, distribute, and display such User Content on the Site, social media, marketing materials, and packaging.
12.2 You represent and warrant that your User Content does not infringe any third-party rights and that you have obtained all necessary permissions (including from any minors depicted).
12.3 We may remove or refuse to display any User Content at our sole discretion.
13. Prohibited Conduct
You agree not to:
(a) use bots, scrapers, or automated means to access or collect data from the Site;
(b) interfere with Site functionality or security features;
(c) impersonate any person or entity;
(d) engage in fraudulent activity or attempt to circumvent payment;
(e) resell Products in violation of any applicable bulk-sales or MAP policies;
(f) use the Site for any unlawful purpose or in violation of these Terms.
14. Limitation of Liability
14.1 TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, IN NO EVENT SHALL BLAST LAB LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, OR INJURY) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14.2 OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
14.3 Some jurisdictions do not allow certain limitations; the above may not apply to you to the extent prohibited.
15. Disclaimer of Warranties
15.1 THE SITE, PRODUCTS, AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND.
15.2 BLAST LAB LLC EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
15.3 We do not warrant that the Site or Products will be uninterrupted, error-free, virus-free, or that defects will be corrected.
16. Indemnification
16.1 You agree to defend, indemnify, and hold harmless Blast Lab LLC, its members, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) your use or misuse of the Product;
(b) your violation of these Terms;
(c) your violation of any third-party rights; or
(d) any injury or damage caused by you or anyone using your account or Product.
17. Force Majeure
We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, pandemics, fires, earthquakes, floods, strikes, supply-chain disruptions, manufacturing delays by Goliath Games, carrier delays, or governmental actions.
18. Governing Law
These Terms and your use of the Site and Products shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
19. Dispute Resolution – Mandatory Arbitration & Class Action Waiver
19.1 Any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or the Product shall be resolved exclusively by binding arbitration administered by JAMS under its Streamlined Arbitration Rules & Procedures in San Diego County, California.
19.2 YOU AND BLAST LAB LLC WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. Arbitration shall be individual only—no class or representative proceedings.
19.3 The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
19.4 Exception: Either party may seek injunctive relief in any court for intellectual property infringement or misuse of confidential information.
20. Privacy & Data Protection
Your personal information is governed by our Privacy Policy, which is incorporated in our website. By using the Site, you consent to the collection and processing of your data as described therein, including compliance with the California Consumer Privacy Act (CCPA) and any applicable international data protection laws.
21. Electronic Communications & Marketing
21.1 By providing your email address or phone number, you consent to receive transactional and marketing communications via email and SMS (including automated messages).
21.2 You may opt out of marketing messages at any time by clicking “unsubscribe” or replying STOP. Opt-out does not affect transactional messages.
22. Changes to Terms
We reserve the right to modify these Terms at any time. The new version will be posted on the Site with an updated Effective Date. Your continued use of the Site or retention of the Product after any changes constitutes your acceptance of the revised Terms.
23. Termination
We may suspend or terminate your access to the Site or cancel any pending order immediately, without notice, for any reason, including if you breach these Terms.
24. Miscellaneous
24.1 Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
24.2 No Waiver: Failure to enforce any right does not constitute a waiver.
24.3 Assignment: We may assign these Terms without consent in connection with a merger, acquisition, or sale of assets. You may not assign without our prior written consent.
24.4 Entire Agreement: These Terms, together with the Privacy Policy and any separate written agreements, constitute the entire agreement between you and Blast Lab LLC.
24.5 Survival: Sections concerning warranty, liability, indemnity, arbitration, governing law, and intellectual property survive termination.
